Lawyers for tech billionaire Elon Musk and OpenAI delivered their closing arguments Thursday in a high-stakes trial that could reshape the future of the artificial intelligence industry and alter the balance of power among its biggest players.

Musk, a co-founder of OpenAI in 2015, filed the lawsuit in 2024, accusing CEO Sam Altman and top executives of betraying the company’s original mission.

The billionaire claims OpenAI secretly shifted from a humanitarian nonprofit into a commercial venture, prioritizing profits over the safe development of AI technology.

The trial concludes at a critical juncture for the tech sector. OpenAI, Anthropic, and Musk’s own AI firm are all currently preparing for highly anticipated Initial Public Offerings (IPOs), which are expected to be among the largest market debuts in history.

A victory for Musk could derail OpenAI’s financial plans, as the lawsuit seeks monetary damages, a restructuring of the business, and the ouster of Sam Altman.

However, the final verdict may ultimately hinge on a legal technicality rather than the ethics of AI. OpenAI’s defense team argued that Musk waited too long to take legal action, asserting that the statute of limitations prevents him from claiming damages for events that occurred prior to August 2021.

The presiding judge has already signaled that the timing of the lawsuit is critical. In a court filing last month, the judge stated that if the jury finds Musk failed to file his claims within the allowed timeframe, she will likely direct a verdict in favor of OpenAI, effectively dismissing the case
